Terms of Service

1. Introduction

Please read these Terms of Service ("Terms") carefully before using SnapRise, including our mobile application, website, and related services (collectively, the "Service"). The Service is provided by Code Rustlers ("Company", "we", "us", or "our").

These Terms govern your access to and use of the Service and form an agreement between you and Code Rustlers. By accessing or using SnapRise, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect information.

2. Definitions

• Application means the SnapRise mobile application provided by Code Rustlers and downloaded by you on a device.
• Application Store means Apple App Store, Google Play Store, or any other digital distribution service through which the Application is made available.
• Company means Code Rustlers, located in Mumbai, India.
• Device means any phone, tablet, computer, or other device that can access the Service.
• Feedback means ideas, comments, suggestions, bug reports, or other input you send to us about the Service.
• In-app Purchase means a purchase, subscription, feature, or other paid item bought through the Application or an Application Store.
• Service means the Application, website, and related services operated by Code Rustlers.
• Subscription means paid access to the Service or certain Service features on a recurring basis.
• Terms means these Terms of Service.
• You means the person accessing or using the Service, or the organization on whose behalf that person uses the Service.

3. About SnapRise

SnapRise is a productivity and alarm app designed to help users wake up by completing missions. A mission may require you to take a live photo of an object or scene, such as the sky, a toothbrush, shoes, a sink, a mirror, grass, or a made bed, before an alarm can be dismissed.

Mission verification may use automated checks to determine whether a submitted photo appears to match the selected mission. Verification may not be perfect, and you agree not to misuse, bypass, tamper with, or interfere with the mission system.

4. User accounts

Some features may require you to create an account. You agree to provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs under your account.

You may request account deletion by using available account controls in the Service or by contacting us at hello@snaprise.io. We may retain limited information where required for legal, security, fraud prevention, or legitimate business purposes.

5. Subscriptions and purchases

Certain parts of the Service may require a paid Subscription or In-app Purchase. Prices, billing periods, renewal terms, included features, trial availability, and cancellation options will be shown before purchase.

Subscriptions may renew automatically unless canceled before the renewal date. If your purchase is made through an Application Store, billing, renewal, cancellation, and refund handling are governed by that Application Store's terms and policies.

You are responsible for keeping payment information current where applicable. If payment fails, access to paid features may be suspended, limited, or canceled.

6. Subscription cancellation

You may cancel a Subscription renewal through the account, device, or Application Store settings used for the purchase. Canceling a Subscription stops future renewals, but you may continue to access paid features until the end of the current paid period unless otherwise stated at checkout.

Deleting the Application does not automatically cancel a Subscription. You must cancel the Subscription through the applicable store, billing settings, or support channel.

7. Fees, changes, and refunds

We may change Subscription fees or paid feature pricing from time to time. Any price change will apply as allowed by the applicable purchase platform and law, and you will have an opportunity to cancel before a new renewal price applies where required.

Except where required by law or Application Store policy, paid fees are non-refundable. For purchases made through Apple App Store or Google Play Store, refund requests must be made through the relevant Application Store.

We may offer free trials, discounts, or promotional pricing. Trial or promotional terms may vary and will be shown before purchase.

8. Acceptable use

• Do not use the Service for unlawful, harmful, abusive, fraudulent, or misleading purposes.
• Do not attempt to bypass alarm missions, verification systems, subscriptions, security features, or access controls.
• Do not reverse engineer, copy, modify, scrape, resell, or commercially exploit the Service except as allowed by law.
• Do not upload photos or content that infringes rights, violates law, or contains harmful, abusive, or illegal material.
• Do not interfere with the normal operation, security, or availability of the Service.

9. Safety and alarm reliability

SnapRise is a productivity and lifestyle tool intended to assist with waking up. It is not a medical device, emergency alert system, safety-critical system, or fail-safe reminder service.

Alarm delivery and behavior may depend on your device, operating system, battery level, volume, silent mode, focus mode, notification permissions, background app settings, network connectivity, software updates, and other factors outside our control.

You should maintain an independent backup alarm for important events, including work, school, travel, medication, appointments, examinations, or any time-sensitive obligation.

10. Intellectual property

The Service, including its design, branding, software, text, graphics, features, and functionality, is owned by Code Rustlers or its licensors and is protected by applicable intellectual property laws.

You may not use SnapRise's name, branding, logos, trade dress, or content in connection with any product or service without our prior written permission.

11. Feedback

If you send us Feedback, you allow us to use it without restriction or compensation. You grant Code Rustlers a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, distribute, and incorporate Feedback into the Service or other products.

12. Third-party services and links

The Service may contain links to third-party websites, platforms, stores, payment systems, or services. We do not control and are not responsible for third-party content, policies, practices, or availability.

Your use of third-party services may be governed by their own terms and privacy policies.

13. Termination

We may suspend or terminate access to the Service at any time if you violate these Terms, create risk for the Service or other users, fail to pay required fees, or use the Service in a way that may cause legal, security, or operational issues.

You may stop using the Service at any time. Upon termination, your right to use the Service ends immediately, but sections intended to survive termination will continue to apply.

14. Service availability and changes

We may update, change, suspend, or discontinue any part of the Service at any time. We may also add, remove, or modify features, missions, pricing, eligibility, or platform availability.

We aim to keep SnapRise reliable, but we do not guarantee that the Service will always be available, uninterrupted, secure, accurate, or error-free.

15. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Code Rustlers disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

We do not warrant that the Service will meet your expectations, operate without interruption, identify every mission correctly, prevent oversleeping, or be free from bugs, errors, viruses, or harmful components.

16. Limitation of liability

To the maximum extent permitted by applicable law, Code Rustlers and its suppliers, service providers, team members, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost income, missed appointments, missed work, missed travel, data loss, business interruption, personal injury, loss of privacy, or other damages arising from or related to your use of or inability to use the Service.

To the maximum extent permitted by applicable law, our total liability for any claim related to the Service will be limited to the amount you paid to use the Service during the three months before the event giving rise to the claim, or INR 8,000, whichever is greater.

17. Indemnity

You agree to defend, indemnify, and hold harmless Code Rustlers from claims, damages, liabilities, losses, costs, and expenses arising from your use of the Service, your violation of these Terms, your content, your misuse of mission verification, or your violation of law or third-party rights.

18. Governing law

These Terms and your use of the Service are governed by the laws of India, without regard to conflict of law rules.

19. Dispute resolution

If you have a concern or dispute, you agree to first contact us at hello@snaprise.io and try to resolve it informally.

Subject to applicable law, courts located in Mumbai, Maharashtra, India will have jurisdiction over disputes arising from or relating to these Terms or the Service.

20. Legal compliance

You represent that you are not prohibited from using the Service under applicable laws and that you will comply with all laws that apply to your use of the Service.

If you access the Service from outside India, you are responsible for compliance with local laws.

21. Severability and waiver

If any provision of these Terms is found unenforceable or invalid, that provision will be interpreted to accomplish its purpose to the greatest extent permitted by law, and the remaining provisions will remain in effect.

Our failure to enforce a provision of these Terms is not a waiver of our right to enforce that provision later.

22. Changes to these Terms

We may update these Terms from time to time. When we make changes, we will update the effective date on this page. If changes are material, we may provide additional notice through the Service, website, or email where appropriate.

By continuing to use the Service after updated Terms become effective, you agree to the updated Terms. If you do not agree, you should stop using the Service.
